Shipment is subject to a minimum freight charge of
$875 per unit.
Prices in this document do not take precedence over
point to point, group to point, point to group, group to group or
confidential rates published in this document or elsewhere.
Price is subject to UFC 6000.
1. Railroad accepts maximum carrier liability of
$10,000 per unit for loss and damage to lading in transit. 2. In no event
shall Railroad be liable for special or consequential damages, including
but not limited to loss of use of the product, resulting from loss of or
damage to the product, delay in delivery, or any other cause.
Notations on the bill of lading made for the
convenience of shipper shall have no affect on Railroad liability. Railroad
agrees to transport product over its line with reasonable dispatch.
Railroad does not guarantee rail service on any scheduled time frame. 3.
Shipper expressly acknowledges that Railroad and shipper have agreed to
transport the product at a reduced rate(s)(by Railroad) and reduced
liability structure in lieu of higher rates under 49 U.S.C. section 11706 (Carmack) liability; and that shipper has knowingly and
voluntarily agreed to ship the product under the liability limitations set
out in this item. Shipper acknowledges that "full liability"
coverage commensurate with the Carmack Amendment
at a higher level of freight rate is available from Railroad(s) upon
request. 4. Shipper acknowledges that it and/or its agents are solely
responsible for the testing and inspecting of its products prior and
subsequent to rail transportation. By accepting the shipment at destination
and putting such shipment into commercial use, shipper acknowledges that it
has inspected the shipment and found that it was received from Railroad in
good condition for its intended use.
5. Nothing in this Item, or any other Item of this
price list, shall be construed as restricting Railroad's right to modify
the rates and provisions of this price list at any time. 6. All provisions,
conditions, defenses, limitations and other terms contained herein shall
extend to all agents and subcontractors of the Railroad and any participating
land carrier involved in effectuating the transportation of the shipments.
To determine miles, refer to BNSF Internet Public
Rate Retrieval at bnsf.com. For any mileage not listed use the next greater
mileage that is shown.
Price is subject to a Fuel Surcharge. A Fuel
Surcharge will be applied to the rates or charges in this price authority
for the shipment, as provided for in Item 3375-Series of BNSF Rules Book
6100-Series. This amount will be added to the freight bill.
Empty foreign marked cars that are not in "bad
order" status are chargeabel moves and will
be billed according to the conditions of this tariff (reference AAR Cirular OT-16). If empty cars are moving in reverse
route that is NOT billabel with this tariff.
Transportation under this agreement is subject to
BNSF Rules Book 6100-Series. A copy of this Rules Book may be obtained via
the internet at: www.BNSF.com. If Customer does not have access to the
internet, Customer should contact Price Management at (817) 593-1134 and a
copy of BNSF Rules Book 6100 will be mailed to Customer.
All equipment must be inspected and approved for
subsequent movement by the originating carrier's Mechanical department. No
cars will be accepted for rail movement without an authorized mechanical
inspection notice.
Switching charges at Origin and Destination will be
absorbed up to $250.00. No more than $250.00 per car will be absorbed. Any
additional amount will be assesssed.
Shipper shall be responsible for any charges for
inspection or repairs at origin or enroute that
may be necessary, through no fault of carrier, to insure that car(s),
locomotive or locomotive crane is in safe operating condition for movement
on own wheels. When cars constructed to serve more than one purpose, as a
combination dining car and coach, or combination box car and tank or box
car containing tanks, the highest rate provided for any type of car
represented in the combination will be applied. Equipment must be inspected
by BNSF prior to moving over the rails of the BNSF. In case of mechanical
breakdowns, BNSF will repair or arrange to have repaired by whomever
shipper designates with all charges being paid by shipper.
Rates named herein apply only when the condition of
the locomotive crane permits movement entirely in regular freight train
service.
Shippers are free to obtain commercial insurance at
their expense to protect against the risk of in-transit loss or damage.
If idler car is required, idler will be billed at 163
cents per rail mile, subject to a minimum charge of $292 per car.
Rates in this price list are not applicable on steam
engines, or friction bearing units of any sort. Rates apply when shipment
is moved in regular freight train service, subject to additional charges
named in applicable tariffs or price lists. Rate applicable only upon
receipt of dimensional clearance when required.
Rates do not include the cost of running repairs
necessary to the safe movement of equipment on own wheels. BNSF will not
pay car hire charges on equipment moving under the provisions of rates in
this price list. Charges as named herein are applicable only when condition
of car permits movement to be made.
If inspection at time of tender of shipment discloses
that conditions of car will not permit such handling, shipment will be
refused.
When a shipment is accepted for handling and
inspection during transportation discloses defects for which carrier is not
responsible, which prevent further movement in such service, the shipment
will not be transported beyond such inspection point until cars are
repaired properly for movement beyond.
No mileage allowance will be paid. Customer warrants
that its interest in the equipment used under rates in this price list is
sufficient to permit it to waive full payment of mileage allowances,
customer and railroad agree that railroad will not be liable for mileage
allowances in excess of the above obligation. In the event that a party
other than customer submits a claim to railroad for mileage allowance
payments in excess of railroad's obligation under this price list, customer
shall at railroad's option either (1) release, defend and idemnify railroad from said claim including attorney's
fees and cost of litigation or (2) reimburse railroad for excess mileage
allowances paid by railroad within (30) days of notice by railroad.
